1. Acceptable Use Policy
This Acceptable Use Policy ("AUP") forms an integral part of the Terms of Service of DediFix B.V.
This AUP describes the acceptable use of all products and services provided by DediFix B.V., including but not limited to dedicated servers, virtual private servers (VPS), colocation, cloud services, IP transit, network services and any related products.
By using our Services, you agree to comply with this Acceptable Use Policy in addition to our Terms of Service and applicable laws and regulations.
2. Prohibited Activities
The Client may not use the Services provided by DediFix B.V. for any activity that is unlawful, abusive, harmful to others, interferes with the operation of our network or Services, or violates the rights of third parties.
Without limitation, the following activities are strictly prohibited:
2.1. Engaging in any activity that violates applicable local, national or international laws or regulations.
2.2. Hosting, transmitting, distributing or facilitating malware, ransomware, spyware, viruses, trojans, worms or any other malicious software.
2.3. Performing or participating in Distributed Denial of Service (DDoS) attacks, denial-of-service attacks, network flooding, amplification attacks or any activity intended to disrupt networks, systems or services.
2.4. Attempting to gain unauthorized access to computers, systems, accounts, networks or data belonging to DediFix B.V. or any third party.
2.5. Hosting or operating phishing websites, credential harvesting pages, fake login portals or other fraudulent services intended to deceive users.
2.6. Sending unsolicited bulk email (spam), operating open mail relays, mail bombing or otherwise abusing email services.
2.7. Hosting, distributing or facilitating content that infringes copyrights, trademarks, patents or other intellectual property rights.
2.8. Using the Services to facilitate fraud, financial crime, identity theft, money laundering or any other criminal activity.
2.9. Hosting, distributing or making available content that is unlawful, defamatory, discriminatory, threatening, abusive or otherwise prohibited under applicable law.
2.10. Using the Services in a manner that may negatively affect the stability, security or performance of the DediFix B.V. network or the services provided to other customers.
3. Network Abuse
The Client shall not use the Services in any manner that may interfere with the normal operation, security or integrity of the DediFix B.V. network or the networks of third parties.
The following activities are prohibited:
3.1. Generating excessive network traffic intended to disrupt or degrade services.
3.2. Operating open proxies, open DNS resolvers, open recursive DNS servers, open SMTP relays or any other publicly accessible service that may be abused by third parties.
3.3. Scanning, probing or monitoring networks or systems without the explicit authorization of the owner.
3.4. Circumventing security measures, rate limits or access controls implemented by DediFix B.V. or third parties.
3.5. Exploiting vulnerabilities or attempting to compromise the security of any system, service or network.
3.6. Reselling or redistributing Services in a manner that violates this Acceptable Use Policy or applicable law.
3.7. Operating services that generate excessive abuse complaints or negatively impact the reputation or operation of the DediFix B.V. network.
DediFix B.V. reserves the right to temporarily limit, suspend or disconnect Services where network abuse is detected in order to protect the stability and security of its infrastructure.
4. Content Policy
The Client is solely responsible for all content stored, transmitted, hosted or otherwise made available through the Services.
The following content is strictly prohibited:
4.1. Content that violates applicable local, national or international laws.
4.2. Child sexual abuse material (CSAM) or any content involving the exploitation or abuse of minors.
4.3. Content promoting terrorism, violent extremism or organized criminal activity.
4.4. Phishing websites, fraudulent content, impersonation or deceptive practices intended to obtain personal, financial or authentication information.
4.5. Malware, ransomware, spyware, viruses or any software intended to damage, disrupt or gain unauthorized access to systems or data.
4.6. Content that infringes copyrights, trademarks, patents or other intellectual property rights.
4.7. Content that is defamatory, discriminatory, threatening, harassing or otherwise unlawful under applicable law.
4.8. Content that facilitates fraud, money laundering, sanctions evasion or other criminal activities.
Where DediFix B.V. receives a valid legal request, abuse report or otherwise becomes aware of prohibited content, DediFix B.V. may investigate the matter and remove, disable access to or suspend the affected Services where reasonably necessary to comply with applicable law or protect its network and customers.
5. Enforcement
DediFix B.V. reserves the right to investigate any suspected violation of this Acceptable Use Policy.
Where DediFix B.V. reasonably believes that a violation has occurred, it may take one or more of the following actions, with or without prior notice where permitted by applicable law:
5.1. Issue a warning to the Client.
5.2. Require the Client to immediately remove or disable the offending content or activity.
5.3. Temporarily restrict, suspend or disconnect the affected Service.
5.4. Permanently terminate the Agreement in accordance with the Terms of Service.
5.5. Remove or block access to content that violates this Acceptable Use Policy or applicable law.
5.6. Cooperate with law enforcement authorities, regulatory bodies or other competent authorities where required by applicable law or a valid legal request.
The Client remains responsible for all fees due under the Agreement unless otherwise agreed in writing by DediFix B.V.
DediFix B.V. shall not be liable for any damages resulting from actions reasonably taken to enforce this Acceptable Use Policy or protect its network, customers or legal obligations.
6. Reporting Abuse
If you become aware of any activity that violates this Acceptable Use Policy or applicable law, you are encouraged to report it to DediFix B.V.
Abuse reports should include sufficient information to allow DediFix B.V. to investigate the matter, including, where applicable:
6.1. The IP address, domain name or service involved.
6.2. A description of the alleged abuse or violation.
6.3. Relevant timestamps, log files, screenshots or other supporting evidence.
6.4. Contact details of the reporting party, where further clarification may be required.
Abuse reports may be submitted by email to:
DediFix B.V. will review abuse reports within a reasonable timeframe and may request additional information where necessary. Submission of an abuse report does not guarantee that any specific action will be taken, and DediFix B.V. reserves the right to determine the appropriate response based on the available information, applicable law and its internal policies.
7. Changes to this Acceptable Use Policy
DediFix B.V. reserves the right to amend or update this Acceptable Use Policy from time to time.
Any changes shall become effective in accordance with the applicable provisions of the Terms of Service. Continued use of the Services after the effective date of such changes constitutes acceptance of the revised Acceptable Use Policy.
